DETERRENT – TERMS AND CONDITIONS
GENERAL TERMS
Welcome and Introduction
Welcome to Deterrent. Deterrent provides a subscription-based mobile patrol deterrence service that helps discourage unwanted activity around homes and businesses through visible, randomised nightly patrols.
The purpose of Deterrent’s service is to create a visible presence that discourages criminal or suspicious activity before it occurs. Deterrent is not a police service, emergency responder or alarm monitoring company. Our officers observe, record and report, but do not intervene except in lawful self-defence.
These Terms and Conditions govern the relationship between you and Deterrent. Please read them carefully. By subscribing, renewing, or continuing to use the Services, you agree to be bound by this Agreement.
Deterrent operates under the Australian Consumer Law (ACL) and the Private Security Act 2004 (Vic). Nothing in these Terms limits or excludes your rights under the ACL.
You should also read our Privacy Policy and FAQs, available at deterrent.net.au/faqs, which explain in plain language how the service works, what we do, and what we don’t do. These FAQs do not form part of this Agreement but assist you in understanding the Service and its limitations.
Definitions
In these Terms and Conditions:
Activation Date means the date patrol services commence in your suburb after pre-launch notice;
Agreement means these Terms and Conditions and any order form or online subscription confirmation;
Call-Out means a customer-requested attendance at your premises to investigate a security concern.
Customer / you means the subscriber or occupier of the premises receiving the Services;
Event of Default has the meaning in clause 19.3;
Force Majeure Event means those events described in clause 12.2;
Holiday Mode means a temporary increased patrol frequency for an unattended property, as described in clause 3.5;
Patrol Pass means a randomised external patrol and visual inspection conducted by a Deterrent officer in a marked vehicle;
PPSA means the Personal Property Securities Act 2009 (Cth);
Schedule of Fees and Charges means the current list of applicable fees and charges published at deterrent.net.au/fees (or any successor webpage) and incorporated into this Agreement by reference;
Services means the patrol deterrence and related services described in this Agreement and Part 2; and
Subscription Period means the minimum commitment term you selected when subscribing (for example, six (6) or twelve (12) months).
Subscriptions and Activation
Plans Offered – Deterrent provides several subscription plans described in Part 2, including Silver, Gold, and Platinum.
Minimum Commitment Period – The minimum term for each subscription plan is:
Six (6) months for weekly subscriptions;
Twelve (12) months for annual subscriptions.
Pre-Launch Reservations – You may pre-subscribe before your suburb becomes active. No billing occurs until patrol services commence in your area.
Activation and Billing Start – Deterrent will give you at least seven (7) days’ written notice before your suburb becomes active. Billing begins on the Activation Date.
Holiday Mode and Temporary Pauses – If you will be away, you may request “Holiday Mode” to temporarily increase patrol frequency or pause patrols. The applicable Holiday Mode fee is listed in the Schedule of Fees and Charges. Approval is at Deterrent’s discretion and subject to operational capacity.
Automatic Renewal – Your subscription automatically renews for successive terms equal to the initial period unless you cancel in accordance with clause 21.
Annual Billing Cycle – Annual subscription fees are charged upfront for each 12-month billing cycle. Fees paid for any annual billing cycle (including renewed cycles) are non-refundable, even if you cancel after the renewal date, except where required by law.
Contact and Communication
You can contact us by email at support@deterrent.net.au. We aim to acknowledge all enquiries within ten (10) business days and provide a full response as soon as reasonably practicable.
General Conditions of Service
Patrols generally operate between 10:00pm. and 6:00am., including weekends and public holidays.
Patrols are external and visual only. Deterrent does not provide emergency response, static guarding, or alarm monitoring.
Patrol timing and routes vary nightly to maximise unpredictability.
You agree to ensure that property access is safe, address numbering is visible, lighting is adequate, pets are contained, and hazards are removed.
Patrols may be modified, shortened or skipped due to weather, emergencies, or safety concerns.
Officer Safety and Conduct
All Deterrent officers hold valid Victorian Security Licences, complete background checks, and receive ongoing training.
Patrols are vehicle-based; officers may leave their vehicle only to visually verify or escalate a confirmed incident.
Officers will not physically intervene except in lawful self-defence.
Officers may withdraw if unsafe and notify Victoria and or Federal Police.
You must not obstruct or direct any officer in the course of their duties.
Privacy and Data Protection
Deterrent collects and stores only the personal information necessary to provide the Service, including address, contact details, and patrol verification data (GPS logs, timestamps, and images).
All data are encrypted and stored securely. Deterrent complies with the Privacy Act 1988 (Cth).
Information may be disclosed to police, insurers, or lawful authorities for investigations or verification.
We do not sell, rent or commercialise your data.
Requests for access or correction of your data should be emailed to privacy@deterrent.net.au.
Fees, Billing and Payments
All fees are GST-inclusive and set out in the Schedule of Fees and Charges.
For weekly subscriptions, billing occurs weekly using your nominated payment method.
For annual subscriptions, billing occurs annually using your nominated payment method.
If a payment fails, a Reprocessing Fee applies (see Schedule of Fees and Charges).
Invoices and receipts are electronic.
Services may be suspended for non-payment.
Fee Reviews and Adjustments
Deterrent may review prices and update the Schedule of Fees and Charges periodically.
We will provide at least thirty (30) days’ written notice before any fee increase or new charge.
You may cancel before the change takes effect if you do not agree to the new price.
Customer Responsibilities, Acknowledgments and Risk Allocation
You agree to:
- Provide accurate and current contact, billing, and property details;
- Ensure safe and lawful access for patrol vehicles;
- Maintain lighting, numbering and site conditions;
- Secure pets and hazards;
- Nnotify Deterrent of hazards, changes, or access codes;
- Maintain adequate insurance; and
- Use the Services only for lawful purposes.
- You must cooperate with Deterrent and provide any information reasonably required to perform the Services effectively.
- Deterrent is not responsible for delay, loss, or damage arising from your non-compliance, unsafe conditions, or third-party acts.
- You acknowledge that Deterrent’s patrols are observational and preventative, not emergency response. You must not rely solely on Deterrent’s presence for property protection.
- You indemnify Deterrent, its employees and agents from any loss, liability, or cost (including legal fees) arising from your breach, negligence, or unsafe conditions, except where caused by Deterrent’s negligence or breach of law.
Risk, Service Nature, and Insurance
Deterrent provides a risk-reduction service, not guaranteed protection.
Patrols deter crime but do not prevent all incidents.
You must maintain insurance for your property and contents.
Deterrent is not liable for losses preventable by reasonable security measures within your control.
Force Majeure
Deterrent is not responsible for any delay or failure to perform its obligations under this Agreement to the extent that the delay or failure is caused by a Force Majeure Event.
A Force Majeure Event includes, without limitation:
- Severe weather, natural disasters or acts of God;
- Power or communications outages;
- Epidemic, pandemic, quarantine or government restriction;
- Civil unrest, strikes, lockouts or industrial disturbances;
- Police or emergency-service operations that restrict access; and
- Any other cause beyond Deterrent’s reasonable control.
If a Force Majeure Event occurs, Deterrent may suspend or modify the Services for the duration of the event and will resume normal operations as soon as reasonably practicable.
Suspension of the Services under this clause does not constitute a breach of this Agreement and does not entitle you to any refund or compensation, provided Deterrent acts in good faith and resumes Services once reasonably able.
Liability, Consumer Guarantees and Limitation of Remedies
Consumer Guarantees – The Services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to cancel and receive a refund for unused Services. For minor failures, you are entitled to have the Service resupplied or reimbursed.
When Remedies Do Not Apply – Without limitation, you are not entitled to a refund or remedy if:
- You received what you ordered but simply changed your mind, found a cheaper option, or decided you no longer want it;
- The issue arose because you misused the Service, failed to maintain access, or ignored safety instructions;
- You knew of or were informed of a limitation before subscribing;
- You directed Deterrent to
provide Services contrary to advice; or - The issue was caused by someone other than Deterrent.
Cascading Limitation of Liability – To the fullest extent permitted by law, Deterrent’s total aggregate liability (whether in contract, tort, equity, or statute) is limited to:
- The total fees paid in the most recent billing cycle preceding the event; or
- If that limit is deemed unenforceable by a court or tribunal of competent jurisdiction, to all fees paid during the current Subscription Period; or
- If that limit is deemed unenforceable by a court or tribunal of competent jurisdiction, to Deterrent’s reasonable direct costs of providing the Services; and
- If that limit is deemed unenforceable by a court or tribunal of competent jurisdiction, to your total direct and reasonably foreseeable losses, excluding indirect or consequential loss.
- Deterrent is not liable for indirect, consequential, or third-party losses; loss of profits, goodwill, or opportunity; or losses caused by weather, emergencies, outages, crime, or other events outside its control.
If you or a third party contributed to any loss, Deterrent’s liability will be reduced proportionally.
Any advice, report, or information provided by Deterrent is general deterrence guidance only and not a guarantee of safety.
Nothing in this clause limits Deterrent’s other legal rights or remedies.
What We Don’t Promise
Deterrent does not warrant that patrols will occur at fixed times, that all suspicious activity will be detected, or that data systems will be real-time or error-free.
Patrols may be delayed or omitted due to safety or operational reasons.
Nothing in this clause limits your ACL rights.
General Disclaimer
Deterrent provides a deterrence-only patrol service. It is not a police, alarm-response or emergency-attendance service. You are responsible for maintaining suitable locks, alarms, CCTV, lighting and insurance.
You acknowledge that Deterrent’s presence reduces risk but cannot eliminate it, and that you must take your own precautions for personal and property safety.
Legal Responsibility
Deterrent operates under Victorian private security licensing.
We cooperate with Victoria Police and lawful authorities where required.
You must not interfere with patrols or misuse company property.
Special Conditions for Certain Plans
Each plan has inclusions and limits described in Part 2.
Renewing and Ending Your Subscription
Subscriptions renew automatically unless cancelled under clause 21.
If your subscription renews on an annual basis, the annual fee will be charged upfront on the renewal date for the next 12-month billing cycle. To avoid renewal, you must cancel before the renewal date in accordance with clause 21. Annual renewal fees are non-refundable, except where required by law.
After the minimum term has expired, you may cancel your subscription at any time by providing fourteen (14) days’ written notice in accordance with clause 21. Subject to termination under clause 22.3, no refund applies to any fees already paid, including any annual subscription fees paid upfront for a renewed annual billing cycle. Your subscription will remain active until the end of the notice period and any outstanding fees are paid.
If you cancel your subscription before the end of the minimum term, you must pay an Early Termination Fee (see Schedule of Fees and Charges). No refund applies to any fees already paid.
Deterrent may terminate immediately for serious breach, misconduct, or safety concerns.
Overdue Fees, Suspension and Default
If payment is overdue by more than fourteen (14) days, we may suspend Services.
Continued non-payment may result in termination and recovery.
An Event of Default occurs if you fail to pay, breach the Agreement, or become insolvent.
On default we may: suspend or terminate Services; register a security interest (if applicable under clause 23); appoint an agent or receiver; and recover Enforcement Costs (see Schedule of Fees and Charges).
Debt Collection and Enforcement
Unpaid accounts may be referred to a debt collector.
You must pay reasonable recovery costs (see Schedule of Fees and Charges).
Deterrent complies with ACCC/ASIC debt collection guidelines.
Cancellation Process
To cancel, email support@deterrent.net.au with your name, address, and customer number.
Deterrent will confirm receipt within five (5) business days.
The Service remains active until your notice period ends and all fees are paid.
Transferring Your Subscription
You must notify us if you wish to transfer your subscription to a new address.
If your new address is within an active patrol zone, the transfer will be subject to our approval (including consideration of our capacity, operational requirements and any other relevant factors).
This clause takes priority over any provision relating to cancellation within the minimum commitment period or Early Termination Fees. If you notify us that you wish to transfer your subscription and your new address is outside an active patrol zone, we will advise you that we do not service that area. You must then confirm the last day you require patrol services at your current address. Your subscription will end on that date, and we will refund you 20% of the total subscription fees you have actually paid for the current plan period up to the effective date of termination. We will process the refund within [insert] days after the effective date of termination.
Your subscription cannot be assigned without our prior written consent.
Security Interest (Business Customers Only)
This clause applies only where the Customer is a company, partnership or business entity.
To secure payment, the Customer grants Deterrent a security interest over all its present and after-acquired personal property.
Deterrent may register its interest on the PPSR.
Deterrent will exercise such rights only as reasonably necessary and in good faith.
This clause does not apply to individual consumers or personal-use subscriptions.
Amendments to These Terms
Deterrent may update these Terms or the Schedule of Fees and Charges from time to time.
Changes that materially affect you will be notified at least fourteen (14) days before taking effect.
Continued use after notice means acceptance.
Entire Agreement and Severability
This Agreement, together with the Schedule of Fees and Charges, any written subscription confirmation, and any document expressly incorporated by reference, constitutes the entire agreement between you and Deterrent and supersedes all prior understandings or representations about the Services.
You acknowledge that you have not relied on any representation, warranty or statement that is not expressly set out in this Agreement.
If any part of this Agreement is found to be invalid or unenforceable, that part will be read down or severed and the remaining provisions will continue in full force and effect.
Governing Law
This Agreement is governed by the laws of Victoria, Australia. Both parties submit to the jurisdiction of the Victorian courts.

• Priority escalation so suspicious activity is acted on first
• Access to our mobile app, where you can view patrol logs and detailed reports.
• Real-time Notifications
• Direct line to our operations team
• GPS Tracked vehicles
• Vehicle equipped with 360° surveillance cameras
• Marked vehicles for strong deterrence
• Incident reports of suspicious activity
• Collaboration with local law enforcement
C. Platinum Plan
• 2 x Patrol Passes per night, spaced out for maximum viability
• Patrol coverage for an additional property within a 10 km radius
• Priority escalation so suspicious activity is acted on first
• Access to our mobile app, where you can view patrol logs and detailed reports.
• Real-time Notifications
• Direct line to our operations team
• GPS Tracked Vehicles
• Vehicle equipped with 360° surveillance cameras
• Marked vehicles for strong deterrence
• Incident reports of suspicious activity
• Collaboration with local law enforcement
Add-Ons and Optional Services
• Additional patrols, reports, or multi-property coverage may be requested at any time and are subject to availability. These services will incur additional charges. Please contact us to enquire about add-on options and we will provide further details.
General Exclusions and Limitations
• Deterrent is not liable for theft, vandalism, or criminal acts that occur despite patrols.
• Patrols may be delayed or cancelled during weather, police or emergency events.
• Deterrent is not an insurer or law enforcement agency.
• Officers remain vehicle-based and do not enter premises except with written consent.
Service Areas
Coverage areas are published at deterrent.net.au/service-areas. Pre-launch reservations incur no charge until activation.
Complaints and Support
Contact support@deterrent.net.au. Deterrent will acknowledge complaints within ten (10) business days and seek to resolve them promptly.

Subscription Fee – Silver Plan
$40 per week or $1,872 per year
Subscription Fee – Gold Plan
$65 per week or $3,042 per year
Subscription Fee – Platinum Plan
$120 per week or $5,616 per year
Early Termination Fee – Early Termination Fee means an amount equal to the subscription fees that would have been payable for the remainder of your minimum term as at the date you request cancellation.
Holiday Mode Fee – $20 per week
